Sunsibility Sun Protection — Terms and Conditions of Sale
These Terms apply to any contract for the sale of products from the website. By ordering, you agree to be bound by them. They were last updated on 1st May 2014.

2. Our Products
- Images are illustrative only; colours may vary on different screens.
- Because products are handmade, sizes and measurements have a 5–10% tolerance.
- Packaging may differ from images shown.
- All products are subject to availability; if unavailable, you'll be contacted and offered a replacement or refund.
- You must be at least 18 years old to purchase as a consumer.
- Your statutory legal rights regarding faulty or misdescribed goods are unaffected.
3. How We Use Your Personal Information
Personal information is used in accordance with their Privacy Policy (see below). Cookies are also used on the site; continued use implies consent.
4. How the Contract is Formed
- You can check and amend errors before submitting an order.
- An acknowledgement email is sent upon receipt of order — this does not constitute acceptance.
- A Dispatch Confirmation email forms the contract.
- If a product is unavailable or mispriced, you'll be offered a replacement or full refund.
5. Our Right to Vary These Terms
Terms may be revised due to changes in payment acceptance or relevant laws. The terms in force at the time of ordering apply.
6. Your Consumer Right of Return and Refund
- You have a legal right to cancel within 14 days of receiving the product (under the Consumer Contracts Regulations 2013).
- This does not apply to personalised or custom-made products.

- Return the products within 14 days of cancellation notice, at your own cost (unless faulty/misdescribed).
- Return addresses vary by brand:

- Wallaroo Headwear: Unit 15, Radar Way, Christchurch Business Park, Christchurch, Dorset BH23 4FL

- Reimbursement is made within 14 days of receiving returned goods (using the same payment method).
- Deductions may be made for loss in value from unnecessary handling beyond what would be allowed in a shop.
- Faulty/misdescribed goods: full refund including delivery and reasonable return costs.
7. Delivery
- Orders fulfilled within 30 days of contract formation unless subject to Events Outside Our Control.
- Delivery completed when products arrive at the address provided.
- Products become your responsibility upon delivery.
- Ownership passes once full payment (including delivery charges) is received.
8. International Delivery
- Delivery available to listed International Delivery Destinations.
- Orders may be subject to import duties and taxes upon arrival — these are the buyer's responsibility.
- You must comply with all applicable laws of the destination country.
9. Price of Products and Delivery Charges
- Prices are as quoted on the site; delivery charges are separate.
- Prices include VAT where applicable; VAT adjustments may apply if the rate changes before delivery.
- If a pricing error is discovered, you'll be contacted and given the option to proceed at the correct price or cancel.
- Obviously mispriced items do not have to be honoured at the incorrect lower price.
10. How to Pay
- Payment accepted via: PayPal, cheque, postal order, BACS, international bank transfer, debit or credit card (all major cards accepted).
- Payment is taken in advance upon receipt of order.
11. Manufacturer Guarantees
- Some products carry a manufacturer's guarantee (see individual product documentation).
- This is in addition to, not a replacement for, your statutory legal rights.
12. Our Warranty for the Products
- Products without a third-party guarantee carry a 12-month warranty against material defects from delivery.
- Warranty does not cover: fair wear and tear, wilful damage, accidents, negligence, incorrect use, unauthorised repair, or customer-provided specifications.
13. Our Liability
- Liable only for foreseeable loss or damage resulting from breach of these Terms or negligence.
- Products are for domestic/private use only — no liability for commercial losses.
- Liability is not excluded for: death or personal injury from negligence; fraud; breach of Sale of Goods Act (ss.12–15); or defective products under the Consumer Protection Act 1987.
14. Events Outside Our Control
Covers acts/events beyond reasonable control including strikes, civil unrest, war, natural disasters, terrorism, or failure of transport/telecommunications infrastructure. If such an event occurs, you'll be notified and a new delivery date arranged.
15. Communications Between Us
- All written communication includes email.
- Cancellations and other notices can be sent to info@sunsibility.co.uk or by post to 88 Jasmin Road, Epsom, Surrey KT19 9EA.
16. Other Important Terms
- Rights/obligations under a Contract may be transferred to another organisation, with notice given to you.
- You may only transfer your rights with written consent (except gifted products, where warranty passes to the recipient automatically).
- These Terms are governed by English law; courts of England and Wales have jurisdiction (with options for Northern Ireland/Scotland residents).
- For businesses: exclusive jurisdiction of England and Wales courts.
Privacy Policy

Data collected includes:
- Information you provide (name, address, email, phone, payment details, etc.)
- Technical/browsing data collected automatically (IP address, browser, clickstream, page visits, etc.)
- Information received from third parties (business partners, analytics providers, etc.)
How it's used:
- To fulfil orders and provide customer service
- To send information about similar goods/services (with consent where required)
- For site administration, improvement, security, and advertising effectiveness
Disclosure: Data may be shared with business partners, advertisers (aggregated only), analytics providers, credit reference agencies, and in the event of a business sale or legal obligation.
Data storage: May be transferred outside the EEA. Stored on secure servers; payment transactions encrypted via SSL.
